Terms and Conditions
The following outlines the terms and conditions governing your use of telehealth services provided by iindi.
Our Services
We provide telehealth services that allow you to connect with Healthcare Practitioners remotely for consultations, advice, and information related to your health and well-being.
Our Services are intended to complement, not replace, traditional in-person healthcare.
The Healthcare Practitioners providing Services through our Platform are registered healthcare professionals in Australia and operate as independent sub-contractors.
We do not guarantee that a particular Healthcare Practitioner will be available at any specific time.
The scope of Services provided may vary depending on the Healthcare Practitioner and the nature of your health concerns.
Your Responsibilities
You are responsible for providing accurate and complete information about your health history, current symptoms, and any other relevant information requested by the Healthcare Practitioner.
You must ensure that you have the necessary technology and internet access to utilize our Services.
You agree to use our Services in a responsible and respectful manner.
You are responsible for following the advice and recommendations provided by the Healthcare Practitioner.
In case of a medical emergency, you should immediately contact emergency services (e.g., dial 000 in Australia) or attend the nearest hospital emergency department. Telehealth is not appropriate for emergency situations.
Appointments and Cancellation Policy
Appointments for telehealth consultations must be scheduled through our platform.
You will receive confirmation of your appointment time and date.
Cancellation or rescheduling of an appointment requires a minimum of 48 hours (2 full days) notice prior to the scheduled appointment time.
If you cancel or reschedule an appointment with less than 48 hours notice, or if you fail to attend a scheduled appointment without prior notice, you will be charged a cancellation fee equivalent to the full consultation fee.
We reserve the right to cancel or reschedule appointments due to unforeseen circumstances or Healthcare Practitioner unavailability. In such cases, we will make reasonable efforts to notify you and offer an alternative appointment time or a refund.
Fees and Payment
The fees for our Services will be clearly displayed on our Platform or communicated to you at the time of booking.
Payment for Services is required 2 or more days prior to the booking or as otherwise specified.
All fees are stated in Australian Dollars (AUD) and are inclusive of any applicable Goods and Services Tax (GST).
We reserve the right to change our fees at any time, but will provide reasonable notice of any such changes.
Refunds may be provided at our discretion in accordance with our Refund Policy (if applicable) or as required by Australian Consumer Law.
Privacy and Security
Your privacy is important to us. We take reasonable measures to protect the security of your personal information and the confidentiality of your consultations. However, we cannot guarantee absolute security of electronic communications.
By using our Services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.
Intellectual Property
The content on our Platform, including text, graphics, logos, and software, is owned by or licensed to us and is protected by copyright and other intellectual property laws.
You may not reproduce, modify, distribute, or commercially exploit any content from our Platform without our prior written consent.
Disclaimer of Warranties
Our Services are provided on an "as is" and "as available" basis.
We make no warranties, express or implied, regarding the suitability, reliability, availability, timeliness, or accuracy of our Services or the information provided by Healthcare Practitioners.
We do not warrant that our Platform will be error-free or uninterrupted.
You acknowledge that the use of telehealth services involves inherent limitations and that the Healthcare Practitioner's ability to diagnose and treat your condition may be limited compared to an in-person consultation.
Limitation of Liability
To the maximum extent permitted by law, We shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with your use of our Services, including but not limited to:
Any reliance on information provided through our Services;
Any delay or inability to use our Services;
The conduct or advice of any Healthcare Practitioner. Any claims regarding the professional services, advice, or conduct of the Healthcare Practitioner should be directed to the Healthcare Practitioner themselves, who maintain their own professional indemnity insurance;
Any technical issues or errors on our Platform.
Our total liability to you for any claim arising out of or relating to these Terms and Conditions or your use of our Services shall not exceed the total fees paid by you to us in the twelve (12) months preceding the event giving rise to the liability.
This limitation of liability does not exclude or limit any rights or remedies that you may have under the Australian Consumer Law that cannot be lawfully excluded or limited.
Indemnification
You agree to indemnify and hold Us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of our Services, your breach of these Terms and Conditions, or your violation of any applicable law or the rights of any third party. This indemnification does not extend to claims arising directly from the professional negligence or misconduct of the sub-contracted Healthcare Practitioners, as they maintain their own professional indemnity insurance.
Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws in Australia. You agree to submit to the exclusive jurisdiction of the courts for the resolution of any disputes arising out of or relating to these Terms and Conditions or your use of our Services.
Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Us regarding your use of our Services and supersede all prior or contemporaneous communications and proposals, whether oral or written.
